Limo Hire Melbourne - Terms and Conditions

These terms and conditions, as amended from time to time, govern all aspects of the relationship between you and Westbourne Limousines and its associated entities. By accessing or using this service you agree to be bound by these terms and conditions.

Definitions

"Customer"

means the person who is named on and has executed the booking form.

"Charter"

means the time from the commencement of the booking until the end of the booking.

"Charter Company"

means Westbourne Limousines and any associated entity.

"Chartered Vehicle"

means it's operated by the charter company.

Deposits and Bookings

  1. By requesting a booking via phone, email or in writing, the Customer agrees that he/she are bound by these terms and conditions.  All quotes provided are valid for 7 days only and are in Australian dollars.
  2. Bookings will be confirmed once a credit card payment has been approved and accepted.  Upon confirmation of payment of the deposit, or full payment, the Charter Company will confirm the Customer's payment and their booking.
  3. All payments are NON refundable, unless otherwise agreed by the Charter Company, and are subject to the terms of the section titled "Refunds Policy" of these terms and conditions.
  4. All and any charter fees owing shall be paid withing 7 days of the agreed hire day.
  5. Additional charter fees will apply after the expiration of 15 minutes from the prearranged booked time if the charter runs over time.  The overtime fee will be double the standard hourly rate charged for the booking and is due and payable to the driver when the charter has concluded.
  6. In the event that the Chartered Vehicle is involved in an accident or has mechanical failure or is not safe to be driven, prior to the commencement of the charter the Charter Company shall make alternative travel arrangements to deliver the Customer and the Customer's guests to their destination.  The Charter Company may at its sole discretion determine the method of onward travel.  The Customer accepts that the Charter Company makes no specific guarantees with regards to events out of the Charter Company's control and they will not hold the Charter Company liable in this respect.
  7. The following fees will automatically be charged to your credit card and you will not be notified again of these charges.
    (a) Overtime charges, if not paid in cash;
    (b) Any balance owing, if not paid in cash. 
    (c) Any damage caused to the vehicle to the extent that the damage was caused by the Customer and/or the Customer's guests.
    (d) Unnecessary mess that is left in the car will incur cleaning charges only to the extent that the damage was caused by the Customer or the Customer's guests.
  8. Any cancellations must be made with no less than 6 weeks notice failing which your credit card will be charged the entire amount owing for the charter booked. Cancellations must be made in writing and will only be considered cancelled after you have received confirmation from the charter company.
  9. If a full or partial payment is made by credit card, a photo ID will be requested to identify the card holder

Chartered Vehicle

  1. The Charter Company is not liable in the event of a mechanical breakdown while on charter. The Charter Company will use every best endeavor to ensure that the Chartered Vehicle is maintained at an acceptable standard at all times.
  2. The Customer acknowledges that the Charter Company shall not be held liable for any mechanical breakdowns or any other disturbances of the Hire however due to mechanical malfunctions prior or during the Hire including road/other accidents or if the vehicle deemed unsafe to drive, then the company shall endeavour, without guarantee to do so, make alternative arrangements to get the Hirer to their destination.   This however does not guarantee that the alternative transport arrangement would be identical to the vehicle originally hired; the customer acknowledges that there may be a variation, in colour, year, interior design/options and other specifications.  The customer agrees that there will be no refunds made what so ever in the occasion that the alternative transport method is utilised for any period of time.   The customer must refuse to utilise the alternative transport arrangement should he/she wish to discuss refund options.

Customers Liability

  1. The Customer assumes full financial liability and responsibility for any damage to the chartered vehicle caused during the charter by the customer or any members of the Customer's guests.
  2. Smoking is not permitted in any of our vehicles.
  3. A fee of $100.00 will apply for each carpet or seat burn found in the vehicle. The Customer accepts by entering the vehicle that the vehicle is undamaged at the time of the commencement of the charter. Any damage to the Chartered Vehicle or equipments which is not reported to the driver prior to the commencement of the charter will be deemed as damage made by the Customer and or the Customers guests. The following charges: In case of breakage $20 for each champagne flute and $30 for each glass tumbler. In case of loss or damage $150 per each karaoke microphone, $580 for karaoke machine, $70 for each lost remote control.
  4. In addition a cleaning fee of $250.00 is immediately payable by the Customer to the Charter Company If the Customer or any of the Customer's guests cause or allow to be caused through any act or omission the Chartered Vehicle to become unreasonably unclean. If the driver is delayed for his next booking as a result of the need to clean the vehicle under this clause, the Customer will be charged accordingly.
  5. The Charter Company will not be responsible or liable for any personal articles or items left in the Charter Vehicle by the Customer and/or the Customer's guests.
  6. Our limos are not equipped with sunroof; Our Hummer Limousine however is equipped with a roof mounted Emergency Escape, opening this escape is prohibited unless in emergency situations.  If the customer or any of their guests opens the emergency negligently, the trip will be terminated in addition there will be a charges for any damages caused by opening the Emergency Escape.

No illegal activities

  1. It is illegal to stand up through the vehicle's sunroof. Any breach of this clause will result in the charter being terminated immediately.
  2. All Chartered Vehicles cannot be booked to exceed their seating capacity.  The driver will not depart unless this clause is strictly complied with
  3. The Customer accepts that the charter company reserves the right to debit his/her credit card to compensate for any damages caused.
  4. Our limos are not equipped with sunroof; Our Hummer Limousine however is equipped with a roof mounted Emergency Escape, opening this escape is prohibited unless in emergency situations

Termination

  1. The Charter Company, through its employees or agents, has the right to terminate the charter without refund (if there is blatant indiscretion on the part of the customer as determined solely by the vehicle driver).
  2. The charter company will not be responsible for delays or the termination of the charter booking in winter months caused by unsafe road conditions, unsafe driving weather and/or road accidents.
  3. Our limos are not equipped with sunroof; Our Hummer Limousine however is equipped with a roof mounted Emergency Escape, opening this escape is prohibited unless in emergency situations.  If the customer or any of their guests opens the emergency negligently, the trip will be terminated in addition there will be a charges for any damages caused by opening the Emergency Escape.

Refund Policy

  1. To make a booking the Customer is required to make a payment, which amount is specified by management, unless there has been an alternative arrangement. The Customer may choose to pay the full amount of hire, or booking and agrees that this section of the terms and conditions applies to all funds paid, either partial or full.
  2. The Customer may cancel their booking within 14 days of payment, and will receive a full refund of amounts paid.
  3. If the Customer cancels their booking after 14 days of making a booking, their payment will not be refunded.
  4. If the Customer cancels their booking less than 6 weeks prior to the booking date, the full hire amount must be paid by the Customer.

Minimum Hire/Fares

  1. Minimum hire of one hour apply between Monday - Friday and Sunday excluding public holidays and main event days.
  2. The Minimum hire, for all vehicles, on Saturday between 09:00 and 19:00 is 3 hours unless agreed by management.
  3. Minimum, first hour hire and Pick-up and Return fares are as follows:
    • Hummer Limo $550 for the first hour and $900 for Pick-up and Return
    • Ford LTD Luxury Limousine $330 for the first hour and $500 for Pick-up and Return
    • Mercedes Benz E-Class $250 for the first hour and $470 for Pick-up and Return
    • Ferrari 355 F1 $400 for the first hour and $800 for Pick-up and Return
  4. Fares are subject to geographical boundaries and are only valid for suburbs that are within 20Kms radius from Melbourne CBD
